Terms & Conditions

Initially, if you’ve not already done so, please contact Brigid Clarke via email brigidclarke@btinternet.com to check availability. If available, we will hold your reservation for 5 working days from enquiry, pending receipt of agreement to these terms and the initial deposit.

This contract of hire is between the Hirer and the Owners and once signed is legally binding. It is made in England and is governed in all respects by English Law and interpretation.

The Owners reserve the right to revoke or refuse, prior to or during the stay, any booking from parties whom they consider unsuitable for the property.

The Owners have the right to refuse or cancel any booking if the property becomes uninhabitable due to fire, flood or any other cause. A full refund will be made for any payments already made.

Whilst every effort has been made to ensure the property descriptions are correct, the Owners reserve the right to make alterations without prior notice to the Hirer.

Arrival/Departure The property is available for occupation from 5pm on the first day of the holiday and must be vacated by 10am on the last day (unless by prior arrangement). On your last day please vacate the property promptly by 10am, taking care to leave it clean and tidy.

Accommodation No more than 13 persons (11 adults) in the main house and 4 persons in the Farmhouse (infants excluded) must occupy the property. The Owners reserve the right to terminate the hire without notice and without refund for a breach of this condition.

Payment terms

30% on booking (non- refundable within 180 days of arrival date)

35% of the agreed rental payable 90 days prior to the date of your arrival.

35% of the agreed rental, plus damage deposit payable 30 days prior to the date of your arrival.

Non-receipt of any payment by the due date will result in a cancellation. (See policy below)

Bookings made less than 90 days before the arrival date will require non-refundable payment in full to secure the booking.

All payments must be made in sterling unless otherwise agreed.

The damage deposit, less any deductions will be returned in sterling by bank transfer unless otherwise arranged.

On receipt of the final payment of the agreed rental and damage deposit, you will be supplied with details of key collection, house instructions and directions. The Hirer undertakes to ensure that all guests comply with the house instructions.

Damage Deposit £500. The Hirer must keep the property clean and in good order and will be responsible for any damages or breakages. It is expected that Hirers treat the property with respect and care and leave it a clean state. A deduction will be made for phone calls, breakages, damage or additional cleaning, if required, due to the property not being left in a clean and tidy state.

Risks

The Hirer acknowledges and accepts (on behalf of him/herself and all members of his/her party) that there is a risk in occupying the property (in particular the risks associated with the swimming-pool and pond), that the Hirer and his/her party has voluntarily accepted that risk and that therefore the Owners shall not be liable to the Hirer or any member of the party for any injury, death, loss or damage sustained to their property or person, however caused. The Hirer acknowledges liability for these risks and that insurance is available to him/her in respect of the above matters. Please ensure that you are suitably insured.

Pool The Hirer undertakes to ensure that no dangerous acts or omissions are committed in or around the swimming-pool by the Hirer or members of his/her party, in particular that there is no diving, that no drinking glasses, glass bottles or other glass materials are taken in or around the pool, that there is no swimming by any member of the party who has consumed excessive alcohol or drugs and that the pool security system is activated whenever the pool is not in use or is not under the supervision of an adult member of the party. The Hirer will abide by operating instructions supplied.

The Hirer acknowledges and agrees that the Owners shall not be liable to any third party for any breach by the Hirer or any member of his/her party of these terms and conditions and undertakes to indemnify the Owners and to hold the Owners harmless from all loss, claims, damages and costs of any nature whatsoever and howsoever arising which may be incurred as a result of any such breach.

Septic Tank The Hirers agree not to put any foreign objects in any toilets in the property other than toilet paper and body effluence. Failing to comply could cause damage and the hirer will be charged with all expenses incurred for repairs and start-up of the septic tank.

Smoking/Fires Smokers are permitted to stay at the property but there is a strict “No Smoking” policy inside either house at any time. At all times, the Hirers must be aware of fire risk. The authorities impose very heavy penalties, including imprisonment on people found responsible for starting fires.

Cancellation

In the event that the Hirer seeks to cancel the booking, the following charges will apply to cancellations notified to the owners, in writing, or by email:

  • More than 180 days prior to arrival date - 5% of agreed rental

  • 180-91 days prior to arrival date - 30% of agreed rental

  • 90-31 days prior to arrival date - 65% of agreed rental

  • 30 days or less prior to arrival date - 100% of agreed rental

Please ensure that you take out appropriate holiday insurance to cover any unforeseen circumstances.
